DHS Removes Fear-Screening Language From Expedited Removal Forms

The Department of Homeland Security revised forms used in expedited removal, a process that can permit immigration officers to order certain noncitizens removed without a full hearing before an immigration judge. The revisions removed advisals and questions previously used to help identify whether a person fears persecution, torture, or other serious harm if returned. The change has been challenged in court, with opponents arguing that effective fear screening is important for identifying people who may qualify for asylum or protection under U.S. and international law.
